Membership Terms and Conditions

The Membership of this Program is free and by you applying to this Membership, you hereby agree to be bound by the following terms and conditions:-

  1. Definition
    1. These terms and conditions shall have the following definitions:-
    2. ‘TOYO’ means Toyo Tyre Sales And Marketing Malaysia Sdn. Bhd.
    3. ‘Program’ means Toyo Tires Fan Club membership program.
    4. ‘Account’ means member’s details and membership’s record.
    5. ‘Membership’ means those arrangements by which a member agrees to participate in this Program in accordance with these terms and conditions herein contained.
  2. Membership
    1. You must have a valid residential address in Malaysia and aged eighteen (18) years and above in order to be eligible to apply for this Membership.
    2. You may apply this Membership via online by completing the details and information requested in the Membership registration form. By providing the required information, you hereby consent to TOYO in processing your personal data for this Program (“Purpose”) and for other TOYO products, marketing and promotions that may be of interest to you in accordance to the Personal Data Protection Act 2010 (“PDPA”).
    3. Upon successful registration, you will be receiving an email notification and Membership login account from Toyo Tires Fan Club. In the event you fail to receive such email notification within seven (3) working days from the date of registration, you shall send email to us toyo@toyotires.com.my for enquiry.
    4. You are required to protect your login details and prevent from sharing such information with any 3rd party and you shall be responsible to notify TOYO immediately of any change of details or any login issues.
    5. TOYO may at its sole discretion refuse an application for Membership and reserves the right not to disclose the reasons for such refusal.
    6. This Membership can only be accessed and used by the person who registered the account and the Membership is non-transferable
    7. TOYO reserves the right to terminate this Membership without prior notification and any reason should you fail to comply with these terms and conditions including but not limited to the following:-
      1. abuses any privilege accorded to the member under this Program;
      2. engages in any fraudulent activities under this Program; or
      3. is deceased or is declared bankrupt.
      Additionally, TOYO may pursue all available legal and equitable remedies.
    8. For clarification purpose, in the event of any advice or actions of TOYO’s employees and/or agents that are contrary to these terms and conditions, the terms and conditions provided herein shall prevail.
  3. Gifts/Vouchers
    1. Only the Account holder is entitled to place a redemption order. TOYO reserves the right to decline any gifts/vouchers redemption order which is not placed by the Account holder.
    2. Any gifts/vouchers redemption order shall be subject to the availability of the stocks and it shall be on first come first served basis.
  4. General
    1. TOYO may at any time and without prior notice to you change these terms and conditions.
    2. TOYO shall not be held responsible or liable under any of the following circumstances :-
      1. Any delay in replacing, renewing or establishing a new Membership Account or for any unauthorized use of Membership;
      2. Any Gifts/vouchers not being available for any reason whatsoever;
      3. Any failure to notify you of any changes in these terms and conditions;
      4. The suspension and/or termination of this Program; and
      5. Any technical failure of system, including this Program website, self-service phone system and mobile web system, which may impede your transaction.
    3. TOYO shall not be liable to the condition, suitability, quality, fitness or services supplied under this Program to the full extent permitted by law.
    4. TOYO reserves the right to terminate or suspend any or all of this Program at any time at TOYO’s sole discretion without prior notification to you.
    5. By providing your personal information for registration into this Program, you have read and agreed with TOYO’s Privacy Policy.
    6. These terms and conditions or your use of the website shall be governed by and construed in accordance with the laws of Malaysia.
